On December 8, 2017, the Lapland district court has made its judgement on a large set of cases concerning alleged financial crimes committed in the scrap metal industry. Lapin Metallikierrätys Oy and the company's owners have denied all charges. The criminal offenses were serious accounting offenses, serious tax fraud and serious employment pension insurance fraud. The company was required to give up the financial gain obtained by the crimes. The Lapland district court found that Lapin Metallikierrätys Oy had paid 370,000 € of non-declared wages in 2010-2012. As a result, the company had avoided 96,000 € of withholding taxes and just under 8,000 € of employer's social security contributions. The wages outside the payroll accounting had been incorrectly recorded in the company's accounts, in addition to which the wages had not been pension-insured. The defendants were found guilty of aggravated tax fraud, aggravated accounting offenses and aggravated occupational pension insurance fraud. Both defendants were sentenced to 1 year and 9 months in prison. They were also subject to 4-year business bans. The company was sentenced to give up more than 39,000 € in financial gain from the crime to the state.

Follow-up: On December 8, 2017, Lapin Metallikierrätys Oy and the company's owners have expressed their dissatisfaction with the judgment of the Lapland district court. Lapin Metallikierrätys Oy and the company's owners will file an appeal against the judgment of the court with the Rovaniemi court of appeal. The so-called cash-in-hand payroll of 370 000 € consists almost entirely of payments for scrap metals, as well as VAT invoices for work carried out by a subcontractor working on machinery. The district court considered these benefits to be wages. The company and its owners have a completely different view of the course of events.

According to the judgment of the Rovaniemi court of appeal: The amount of salaries paid by Lapin Metallikierrätys Oy has been declared in the employer's seasonal tax returns as 47,853 € too small in 2011 and 2012. As a result, the company has avoided 10,898.33 € of withholding tax and 1,014.53 € of employer's social security contributions, gaining a total benefit of 11 912.86 €.

The salaries paid by Lapin Metallikierrätys Oy have been reported to Varma Mutual Pension Insurance Company 47,853 € short. Salaries missing from the payroll accounting amount to 17,397.50 € in 2011 and 30,455.50 € in 2012. Due to false reporting, pension insurance contributions worth of 3,844.85 € in 2011 and 6,943.85 € in 2012 were left unpaid. A total financial advantage of 10 788.70 € was achieved in this respect.

Based on the facts identified above, the Rovaniemi court of appeal has sentenced the company's owners to seven (7) months' imprisonment for accounting offense, tax fraud and employment insurance fraud. In addition, the owners have been ordered to reimburse the state for the costs in the district court and the court of appeal totaling 963.45 € and for the tax administration's legal costs in the district court and the court of appeal a total of 3,400 €. Lapin Metallikierrätys Oy has been sentenced to pay a loss penalty to the state of 6,433.47 €.

The Rovaniemi court of appeal has not imposed any other sanctions on the company and/or owners. Lapin Metallikierrätys Oy and the company's owners have paid all the damages in full.

Lapin Metallikierrätys Oy's net sales in the financial year 2011 were 9,000,095.60 € and profit was 501,101.20 €. In the financial year 2012 net sales were 7,942,260.23 € and profit was 362,023.79 €. The owners of Lapin Metallikierrätys Oy still believe that the deficiencies in the seasonal tax returns and pension insurance returns are due to negligence and not to intentional criminal activity.
